Justice Dudley Aru
Public Prosecutor
Remo Wisil
Mr. C. Shem for the Public Prosecutor; Mr. D. Yawha for the Defendant

SENTENCE

1. Remo Wisil you pleaded guilty to a single charge of criminal trespass.

2. You were jointly charged with Freddy Wisil, Dadley Wisil, Daniro Wisil, Kaluwas Wisil and Robert Ialu Sawia. They were sentenced on 28 February 2023. You absconded and was not sentenced. The facts are the same.

3. The starting point of your sentence is 8 months imprisonment. Given you breached bail and went overseas I increase the starting point of sentence to 12 months imprisonment. For your guilty plea the sentence start point is reduced by 25%. You are a first-time offender therefor the starting point of sentence is further reduced by 2 months.

4. Your end sentence is 7 months imprisonment. The sentence will not be suspended. It will serve as a deterrent to your future offending. As you have been on bail prior to your sentence you must present yourself to the Centre Manager of the Correctional Centre in Vila by no later than 26 June 2023 unless you elect to begin serving your sentence immediately.

5. Should you fail to comply, the Centre Manager may apply for a warrant for your arrest.

6. You have 14 days to appeal if you are not satisfied with this decision.
